Welcome to Rockintor. This website and online store are operated by Rockintor America LLC, trading as Rockintor (“Rockintor,” “we,” “us” or “our”). We offer this website, its content, features, products and related services (the “Services”) to you. Our store is powered by Shopify.

These Terms of Service (“Terms”), together with the policies linked below, explain the conditions that apply when you use the Services or buy from us. Please read them before placing an order. By using the Services, you agree to these Terms and acknowledge our Privacy Policy. Nothing in these Terms limits rights that cannot legally be excluded, including applicable consumer rights.

SECTION 1 - ACCESS AND ACCOUNT

You must be legally able to enter into a purchase contract in your jurisdiction to place an order. If you allow a minor to use a device or account that you manage, you are responsible for supervising their use of the Services.

You agree to provide accurate, current and complete information when creating an account or placing an order. If you have an account, you are responsible for keeping your login details secure and for activity carried out through it. Contact us promptly if you believe someone has accessed your account without authorization. You may not transfer your account to another person without our consent.

SECTION 2 - OUR PRODUCTS

We aim to describe and display our products accurately. Colors and appearance may vary depending on your device and screen settings. Product descriptions, specifications and availability may change.

Please review the product description, sizing information, care instructions and any preorder notice before purchasing. If you need help choosing a size, contact us before ordering. General information on the website does not replace the fit, care and use instructions supplied with a protective product.

We may discontinue a product or limit available quantities, subject to orders already accepted and applicable law.

SECTION 3 - ORDERS

When you place an order, you offer to buy the products selected at the price shown at checkout. We will send an order confirmation to the email address you provide. We may decline or cancel an order if, for example, a product is unavailable, payment cannot be authorized, or there is a clear pricing or listing error. If we cancel an order after taking payment, we will refund the amount paid for the cancelled items.

Please check your products and delivery details before submitting an order. To request a change or cancellation, contact us as soon as possible at contact@rockintor.com. We will tell you whether the order can still be changed. Your statutory cancellation and return rights, where applicable, remain unaffected.

Our Returns & Warranty Policy explains our return and exchange procedures. Where that policy or these Terms provide less protection than mandatory consumer law, the applicable law prevails.

SECTION 4 - PRICES AND BILLING

Product prices and currencies may vary by market. The product price, available shipping methods, shipping charge and any taxes collected by us will be displayed before you complete checkout. Customs duties, import taxes or clearance fees may also apply to international deliveries where they are not included in the checkout total. We will indicate the applicable delivery arrangement where available.

Prices and promotions may change. A later price change will not alter an order we have accepted. A promotion may have separate eligibility conditions or an expiry date; those conditions apply to that promotion.

You agree to provide accurate payment and billing information and confirm that you are authorized to use your chosen payment method. If you have an account, please keep your contact and billing information current so that we can process your order and contact you when needed.

SECTION 5 - SHIPPING AND DELIVERY

We ship to selected destinations. Available shipping methods, charges and estimated delivery times are shown at checkout. Delivery times are estimates and may be affected by carrier operations, customs processing or events outside our reasonable control. If a material delay affects your order, contact us so we can review the available options.

If a product is sold as a preorder, its product page or checkout may state a separate estimated dispatch or delivery period. Preorders remain subject to applicable cancellation, return and consumer rights.

Responsibility for loss of or damage to goods passes as required by applicable law. In particular, where EU consumer law applies, it generally passes when you or a person you nominate, other than the carrier, takes physical possession of the goods. An exception may apply if you independently arrange a carrier that we did not offer.

SECTION 6 - INTELLECTUAL PROPERTY

The Rockintor name, product names, trademarks, designs, photographs, text, videos and other content available through the Services belong to Rockintor or their respective rights holders and are protected by applicable intellectual property laws.

You may use the website for personal, lawful shopping purposes. Except where permitted by law, you may not reproduce, distribute, modify or commercially exploit its content without permission from the relevant rights holder. Shopify’s name and trademarks belong to Shopify; other third-party names and trademarks belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS

We may make tools or features provided by third parties available through the Services. Separate terms or privacy notices may apply to your use of those tools. We may also add or change website features over time. Nothing in this section excludes a responsibility that applicable law places on us.

SECTION 8 - THIRD-PARTY LINKS

The Services may link to websites or content operated by third parties. We do not control those independent websites. Please review their terms and privacy notices before using them or making a purchase from them. This section does not limit our responsibility for our own products, representations or obligations to you.

SECTION 9 - RELATIONSHIP WITH SHOPIFY

Rockintor is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Rockintor America LLC. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Rockintor America LLC, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Rockintor America LLC, to the extent permitted by applicable law.

SECTION 10 - PRIVACY POLICY

Personal information collected through the Services is handled as described in our Privacy Policy. Shopify also processes information to provide the store platform and related services. Certain personal information may be subject to Shopify’s Privacy Policy.

Our Privacy Policy explains how information may be shared with service providers, including providers located in other countries, and how to exercise applicable privacy rights.

SECTION 11 - FEEDBACK

If you send us a review, suggestion, photograph or other feedback (“Feedback”), you confirm that you have the right to submit it and that it does not infringe another person’s rights or contain unlawful material. You grant us a worldwide, non-exclusive, royalty-free license to use, reproduce and display that Feedback in connection with our products and Services, subject to applicable law and our Privacy Policy.

We may remove Feedback that is unlawful or violates these Terms. If a review was given in exchange for an incentive, that fact must be disclosed. We will not knowingly present content as an independent customer review if it is not one.

SECTION 12 - ERRORS, INACCURACIES AND OMISSIONS

We work to keep product descriptions, prices, stock information and delivery details accurate. If we identify an error, we may correct the website. If an error affects an order, we will contact you about the available options. We will not impose a higher price on an accepted order without your agreement.

SECTION 13 - PROHIBITED USES

You may use the Services only for lawful purposes. You must not interfere with the website’s operation or security; introduce malicious code; attempt to access accounts or data without authorization; impersonate another person; send spam through the Services; or use the Services to infringe another person’s rights.

We may restrict access to an account or the Services where reasonably necessary to address misuse, a security issue or a breach of these Terms, subject to applicable law.

SECTION 14 - TERMINATION

You may stop using the Services at any time. We may suspend or end access to an account or website feature if you materially breach these Terms or if doing so is reasonably necessary for security or legal reasons. Ending access does not cancel our obligations concerning an order already placed or your applicable consumer rights.

Provisions that by their nature should continue, including those concerning intellectual property, outstanding payment obligations and dispute resolution, will continue to apply where legally permitted.

SECTION 15 - SERVICE AVAILABILITY AND WARRANTIES

We aim to keep the website available and its information accurate, but website features may occasionally be interrupted for maintenance, technical reasons or events outside our reasonable control.

Any express commercial warranty offered with a product is described in our Returns & Warranty Policy or the relevant product information. It is additional to, and does not replace or reduce, statutory rights relating to faulty or nonconforming goods. We do not exclude a warranty or condition that applicable law does not allow us to exclude.

SECTION 16 - LIMITATION OF LIABILITY

Nothing in these Terms excludes or limits liability where doing so would be unlawful. These Terms do not remove your statutory rights concerning delivery, withdrawal, returns, faulty goods, product safety or any other mandatory consumer protection.

To the extent permitted by applicable law, we are not responsible for losses that were not reasonably foreseeable when the contract was made, or for losses caused by events outside our reasonable control. This section does not limit any remedy that applicable consumer law makes available to you.

SECTION 17 - INDEMNIFICATION

If you use the Services for a commercial purpose or submit content that infringes a third party’s rights, you may be responsible for losses directly caused by your unlawful conduct or material breach of these Terms, to the extent permitted by applicable law. This section does not require a consumer to give up statutory rights or pay costs for which the consumer is not legally responsible.

SECTION 18 - SEVERABILITY

If a provision of these Terms is found to be unlawful or unenforceable, it will be limited or removed to the extent necessary. The remaining provisions will continue to apply where possible.

SECTION 19 - WAIVER; ENTIRE AGREEMENT

If we do not enforce a provision of these Terms on one occasion, that does not mean we waive the right to enforce it later. These Terms and the policies expressly linked in them describe the agreement concerning your use of the Services, without excluding information or rights that applicable law makes part of a purchase contract.

SECTION 20 - ASSIGNMENT

You may not transfer an account or your obligations under these Terms to another person without our consent, except where applicable law permits it. We may transfer our rights or obligations in connection with a business transfer, provided that doing so does not reduce your rights under an existing order or applicable law.

SECTION 21 - GOVERNING LAW

These Terms are governed by the law applicable to the relevant transaction. Nothing in this section deprives a consumer of mandatory protections provided by the law of their country of habitual residence or of the right to bring a claim before a court available under applicable consumer law.

SECTION 23 - CHANGES TO TERMS OF SERVICE

We may update these Terms by posting a revised version on this page with a new “Last updated” date. The Terms applicable to a purchase are generally those presented when you placed the order, unless a change is required by law or you agree to it. We will provide any additional notice required by applicable law.
